A Chapter 13 bankruptcy is a reorganization of debt where the debtor files a repayment plan with the bankruptcy court to pay back all or a portion of their debts over time. The repayment is contingent on a debtors income, expenses, amount and type of debt and property owned. A Chapter 13 filing may, in certain circumstances, be a favorable option in lieu of foreclosure. This filing is premised on the debtor working out a payment plan so as not to lose his or her property. A debtor must substantiate that they have the ability and income to repay some or all of their debt to the bankruptcy court. Income that is irregular or too low may disqualify a debtor from filing for Chapter 13.
